TENTATIVE RULING:

Petitioner Paul John Denham’s Verified Petition for Writ of Mandate is CONTINUED to _________, 2025, at 1:30 PM, in Department 86 (Stanley Mosk Courthouse).

On 5/28/25, the Court received a document, entitled “Notice of Non-Receipt of Respondent’s Opposition Brief,” which was filed by petitioner. Within this notice, petitioner claims that he has not received respondent’s opposition brief and that, as a result, he is unable to comply with the Court’s 1/30/25 Order that any reply brief must be filed and served by at least 15 days prior to the hearing date. Upon review of the Court’s record, it appears that the petitioner had submitted a change of address form on 5/12/25. Considering the proof of service attached to respondent’s opposition brief lists petitioner’s prior address, it appears likely the opposition brief was not properly routed to petitioner following his transfer.

Accordingly, the Court orders respondent to serve petitioner with its opposition brief to the address identified in petitioner’s Notice of Change of Address or Other Contact Information, filed on 5/12/25. Petitioner shall file his reply brief, if any, fifteen (15) days before the continued hearing date

Lastly, the Court notes that Exhibit 36 is missing from the physical and electronic copy of the Joint Appendix. Respondent shall file a notice of errata and correct this defect.
