Case:               Ally Bank v. Janice Powell (24STCV19516) 

TENTATIVE RULING:

Plaintiff Ally Bank’s UNOPPOSED Application for Writ of Possession is GRANTED. The Court finds that plaintiff has established the probable validity of its claim to possession of the property, namely, a 2020 Chevrolet Corvette (VIN 1G1Y72D40L5117097).

No undertaking is required. The amount owed ($70,047.31) exceeds the market value of the vehicle ($58,200.00). (CCP § 515.010; Singleton Decl. ¶¶ 6, 7 & Exs. C-E.)

At the hearing, the Court will hear from the parties as to what amount, if any, shall be ordered for a redelivery bond pursuant to CCP § 515.020 and its reference to CCP § 515.010.

Within two court days, plaintiff shall submit a Proposed Order on the applicable Judicial Council form in accordance with the Court’s ruling.
