TENTATIVE RULING:

Plaintiff Ally Bank’s UNOPPOSED Application for Writ of Possession is CONTINUED to 9/17/24 at 1:30 PM in Department 86 (Stanley Mosk Courthouse).

The Vehicle Identification Number (VIN) for the 2019 Ram 3500 is listed in the application as 3C63RPGL0KG641408. (Application ¶ 4; see also Singleton Decl. ¶ 5.) However, the VIN listed on the Retail Installment Sales Contract, on which defendant David Montiel purportedly defaulted, is 3C63RPAL2KG641404. (Singleton Decl. ¶ 5 & Ex. A.) It is therefore unclear whether plaintiff is entitled to repossess a vehicle with VIN 3C63RPGL0KG641408.

By no later than 9/6/24, plaintiff Ally Bank is ordered to file a supplemental declaration explaining the difference between the VIN on the application and the Retail Installment Sales Contract.
