TENTATIVE RULING:

 

Plaintiff Evergreen Bank Group dba Freedom Road Financial’s UNOPPOSED Application for Writ of Possession is GRANTED. The Court finds that plaintiff has established the probable validity of its claim to possession of the property, namely, a 2022 Aprillia RSV4 RR (VIN ZD4KYUA06NS000351).  The Court also finds probable cause to believe the property may be found at 21232 Doble Avenue, Torrance, CA 90502, the address used by defendant Fulituaimalo Tamalii as his address on the Retail Installment Sale Contract for the subject vehicle.

 

No undertaking is required. The amount owed ($21,972.51) exceeds the market value of the vehicle ($20,130.00). (CCP § 515.010; Urso Decl. ¶¶ 11-12 & Exs. 3-4.)

 

The Court will sign the Proposed order, electronically received 12/31/24.
