Defendant/Cross-Complainant Stefan Kasian ('Defendant')'s motion to compel Plaintiff/Cross-Defendant Navy Federal Credit Union ('Plaintiff') to provide responses to written discovery, and for sanctions, is denied. Plaintiff's sanctions request is denied.
On March 6, 2023, the court entered a Judgment dismissing Defendant's Cross-Complaint against Plaintiff. See ROA No. 173. On August 30, 2023, the court, following a bench trial held on June 1, 2023, entered a Judgment in Plaintiff's favor and against Defendant in the amount of $146,594.61. See ROA No. 216. Consequently, the court must deny the present motion as moot. Plaintiff's request for an unspecified sanctions amount for opposing the motion is denied as Plaintiff has failed to provide any arguments or evidence substantiating such a request.
In light of the foregoing, the court: (1) denies Defendant's motion to compel Plaintiff to provide responses to written discovery as moot, and (2) denies Plaintiff's sanctions request.
This is the tentative ruling for the hearing at 1:30 p.m. on Friday, November 17, 2023. If no party appears at the hearing, this tentative ruling will become the order of the court as of November 17, 2023.
If the parties are satisfied with the court's tentative ruling or do not otherwise wish to argue the motion, they are encouraged to give notice to the court and each other of their intention not to appear, though this notice is not required.
