Petition to Approve Compromise of Pending Action on Behalf of Minor Neveah Aguilar filed by Petitioner Norma Lopez; Petition to Approve Compromise of Pending Action on Behalf of Minor Ayla Orellana filed by Petitioner Selina Hernandez

Having considered the petitioning papers, the Court rules as follows. 

 

BACKGROUND

 

On March 25, 2019, Plaintiffs Irma Orellana (“Orellana”), Norma Lopez (“Lopez”), N.A. and A.O. filed this action against Defendants City of Los Angeles (“City”), Los Angeles Police Department (“LAPD”) for negligence, intentional infliction of emotional distress, negligent infliction of emotional distress, breach of covenant of good faith and fair dealing, fraud/intentional misrepresentation, negligent misrepresentation, trespass to land, trespass to chattel, false imprisonment and vicarious liability.

On August 21, 2019, the City filed its answer.

On July 21, 2022, Plaintiffs filed a Petition to Approve Compromise of Pending Action on Behalf of Minor N.A., to be heard on August 11, 2022.

 

PARTY’S REQUESTS

Petitioner Norma Lopez asks the Court to approve the compromise of the pending action on behalf of Plaintiff Neveah Aguilar.

Petitioner Selina Hernandez asks the Court to approve the compromise of the pending action on behalf of Plaintiff Ayla Orellana.

DISCUSSION

Petitioners have submitted a completed application

Petitioner requests that the net balance of each be delivered to the guardian of the estate, and that the guardian be allowed to deposit/invest the net balance with a financial institution. For A.O., the balance is to be deposited in Bank of America – Boyle Heights, 2305 East Cesar E Chavez Avenue, Los Angeles, California 90033. For N.A., the balance is to be deposited in Bank of America – LA Chinatown, 850 N Broadway, Los Angeles California 90012.

CONCLUSION

The Petition to Approve Compromise of Pending Action on Behalf of Minor Neveah Aguilar filed by Petitioner Norma Lopez is GRANTED. The Petition to Approve Compromise of Pending Action on Behalf of Minor Ayla Orellana filed by Petitioner Selina Hernandez is GRANTED.  The Court sets a hearing on an Order to Show Cause why the case should not be dismissed and as to the filing of Proofs of Deposit on October 3, 2022 at 8:30 a.m. in Dept. 28 of the Spring Street court house.   

 

Petitioner is ordered to give notice of this ruling.

Petitioner is ordered to file the proof of service of this ruling with the Court within five days.
