Petitions to Approve Compromise of Pending Action on Behalf of Minor Stella Kate Sutton Stowell and Julia Jane Sutton Stowell filed by Petitioner Michelle Sutton

Having considered the petitioning papers, the Court rules as follows. 

BACKGROUND

On May 21, 2019, Plaintiff Michelle Sutton (“Plaintiff” or “Petitioner”) filed this action against Defendants Juan Pedro Ovalle (“Ovalle”) and Arakelian Enterprises, Inc. (“Arakelian”) for motor vehicle negligence.

On April 30, 2021, Defendants filed an answer.

On July 21, 2022, Petitioner filed Petitions to Approve Compromise of Pending Action on Behalf of Minors Stella Kate Sutton Stowell (“Stella”) and Julia Jane Sutton Stowell (“Julia”), to be heard on August 30, 2022.

PARTY’S REQUESTS

Petitioner Michelle Sutton asks the Court to approve the compromise of the pending action on behalf of Claimants Stella Kate Sutton Stowell and Julia Jane Sutton Stowell.

DISCUSSION

Neither Kate nor Julia have been brought in as Plaintiffs to this action. As such, the Court has no jurisdiction to approve compromises on their behalf. The Court denies the motion.

CONCLUSION

Petitions to Approve Compromise of Pending Action on Behalf of Minors Stella Kate Sutton Stowell and Julia Jane Sutton Stowell filed by Petitioner Michelle Sutton are DENIED.

Petitioner is ordered to give notice of this ruling.

Petitioner is ordered to file the proof of service of this ruling with the Court within five days.
