            Having reviewed Defendant G&H Wellness Enterprises, LLC’s unopposed Motion to Deem Requests for Admission Admitted, the Court rules as follows.

 

            On April 21, 2022, Defendant G&H Wellness Enterprises, LLC served Requests for Admission, Set No. One on Plaintiff Tajah Enge.

Responses were due _May 25, 2022. Plaintiff Tajah Enge has failed to provide timely responses.  Defendant G&H Wellness Enterprises, LLC now moves the Court to deem the requests for admission admitted. 

            The Court grants the motion pursuant to Code of Civ. Proc. § 2033.280 and deems the requests to be admitted.

 

Defendant G&H Wellness Enterprises, LLC requests monetary sanctions totaling $1,600.00.

            The Court awards sanctions pursuant to Code of Civ. Proc. § 2023.030 (a) and Code of Civ. Proc. § 2033.280 (c) in the amount of $720.00, calculated as follows:

Defendant requests $1,600.00 in sanction based upon 7 hours of attorney’s work, at a rate of $220.00 per hour, and one $60.00 filling fee. Attorney’s work is estimated as 2 hours preparing the motion, 1 hour reviewing the opposition, and 4 hours traveling to and appearing for the hearing on this motion. Plaintiff has not opposed the motion. Thus, the Court grants $720.00 in sanctions, based upon 3 hours of attorney’s work.

The sanctions total $720.00 and are payable by Plaintiff Tajah Enge and her counsel by September 25, 2022.
