Ruling on Defendant Ritz Flooring, Inc.’s Unopposed Motion to Deem Requests for Admission Admitted
Having reviewed Defendant Ritz Flooring, Inc.’s unopposed Motion to Deem Requests for Admission Admitted, the Court rules as follows.
On October 25, 2022, Defendant Ritz Flooring, Inc. served Requests for Admission, Set No. Two on Plaintiff Gilberto Gonzalez.
Responses were due November 30, 2022. Plaintiff Gilberto Gonzalez has failed to provide timely responses. Defendant Ritz Flooring, Inc. now moves the Court to deem the requests for admission admitted.
The Court grants the motion pursuant to Code of Civ. Proc. § 2033.280 and deems the requests to be admitted.
Defendant Ritz Flooring, Inc. requests monetary sanctions totaling $555.00.
The Court awards sanctions pursuant to Code of Civ. Proc. § 2023.030 (a) and Code of Civ. Proc. § 2033.280 (c) in the amount of $390.00, calculated as follows:
Defendant requests sanctions totaling $555.00, based on 3 hours of attorney’s work, at a rate of $165.00 per hour and one $60.00 filling fee. This is based on 1 hour drafting the motion and 2 hours reading any opposition and appearing at the hearing. The motion is unopposed, the Court grants sanctions based on two hours of attorney’s work.
The sanctions total $390.00 and are payable by Plaintiff Gilberto Gonzalez and his counsel by March 2, 2023.
