Ruling on Defendant Lorraine Factor’s Unopposed Motion to Deem Requests for Admission Admitted

            Having reviewed Defendant Lorraine Factor’s unopposed Motion to Deem Requests for Admission Admitted, the Court rules as follows.

            On April 12, 2022, Defendant Lorraine Factor served Requests for Admission, Set No. One on Plaintiff Christopher Watts.

Responses were due May 17, 2022.  Plaintiff Christopher Watts has failed to provide timely responses.  Defendant Lorraine Factor now moves the Court to deem the requests for admission admitted. 

            The Court grants the motion pursuant to Code of Civ. Proc. § 2033.280 and deems the requests to be admitted.

Defendant Lorraine Factor requests monetary sanctions totaling $1,230.00.

            The Court awards sanctions pursuant to Code of Civ. Proc. § 2023.030 (a) and Code of Civ. Proc. § 2033.280 (c) in the amount of $ 645.00, calculated as follows:

Defendant requests sanctions totaling $1,230.00 based upon 6 hours of attorney’s work at a rate of $195.00 per hour and one $60.00 filling fee. The Court awards sanctions totaling $645.00, based upon 3 hours of attorney’s work.

The sanctions total $645.00 and are payable by Plaintiff Christopher Watts and his counsel by October 28, 2022.
