Ruling on Defendant Enzo Mattucci’s Unopposed Motion to Deem Requests for Admission Admitted

            Having reviewed Defendant Enzo Mattucci’s unopposed Motion to Deem Requests for Admission Admitted, the Court rules as follows.

            On July 15, 2021, Defendant Enzo Mattucci served Requests for Admission, Set No. One on Plaintiff Esmeralda Sanchez.

Responses were due February 2, 2022. Plaintiff Esmeralda Sanchez has failed to provide timely responses. Defendant Enzo Mattucci now moves the Court to deem the requests for admission admitted. 

            The Court grants the motion pursuant to Code of Civ. Proc. § 2033.280 and deems the requests to be admitted.

Defendant Enzo Mattucci requests monetary sanctions totaling $601.65.

            The Court awards sanctions pursuant to Code of Civ. Proc. § 2023.030 (a) and Code of Civ. Proc. § 2033.280 (c) in the amount of $601.65, calculated as follows:

Defendant requests sanctions totaling $601.65, based upon 3 hours of attorney’s work at a rate of $180.00 per hour and one $61.65 filling fee. The Court fins the request reasonable and grants it in full.

The sanctions total $601.65 and are payable by Plaintiff Esmeralda Sanchez and her counsel by October 22, 2022.
