Having considered the petitioning and moving papers, the Court rules as follows.

BACKGROUND

On December 7, 2020, Plaintiffs Oscar Garcia (“Oscar” or “Petitioner”), Iris Yaneth Soriano (“Soriano”), Xiomarra Yovanna Garcia (“Xiomarra”) and Luna Yahaira Garcia (“Luna”) filed this action against Defendant Thomas Evans (“Defendant”) for motor vehicle negligence and general negligence.

On December 23, 2022, Petitioner submitted a Petition for Approval of Minor’s Compromise to be heard on February 9, 2023.

PARTY’S REQUESTS

Petitioner Oscar Garcia asks the Court to approve the compromise of the pending action on behalf of Plaintiff Luna Yahaira Garcia.

DISCUSSION

Petitioner’s application is complete with all applicable attachments. The Court grants the petition.

Petitioner requests the net balance be placed in a blocked account at Wells Fargo Bank, 900 W. Airport Fwy, Irving TX, 75062. The amount must be placed within a financial institution in this state; the Court orders Petitioner to appear and provide an appropriate address for a financial institution.

CONCLUSION

Petition to Approve Compromise of Pending Action on Behalf of Minor Luna Yahaira Garcia filed by Petitioner Oscar Garcia is GRANTED. Petitioner is ordered to appear to submit a proper address within the state for depositing the net balance.

            Petitioner is ordered to give notice of this ruling.

Petitioner is ordered to file the proof of service of this ruling with the Court within five days.
