Having considered the petitioning papers,
the Court rules as follows.
BACKGROUND
On April 12, 2021, Plaintiff Emma
Lynn Espindola (“Plaintiff”) filed this action against Defendants 11884 Manor
Drive LLC (“Manor”) and Fernando Fayzano (“Fayzano”) for general negligence,
premises liability and wrongful death. Plaintiff later amended the complaint to
include Defendant Jeffrey Bellandi (“Bellandi”).
On June 14, 2021, Manor and Fayzano
filed an answer. On October 22, 2021, Bellandi filed an answer.
On February 7, 2023, Petitioner Ana
Erika Espindola (“Petitioner”) submitted a Petition for Approval of Minor’s
Compromise to be heard on March 14, 2023.
There is no currently scheduled
trial date.
PARTY’S REQUESTS
Petitioner
Ana Erika Espindola asks the Court to approve the compromise of the pending
action on behalf of Plaintiff Emma Lynn Espindola.
DISCUSSION
Petitioner’s
application is complete with all applicable attachments. The Court grants the
petition.
Petitioner
requests the net balances be deposited in a single-premium deferred annuity as
outlined in Attachment 18b(3). The Court orders the balance so distributed.
CONCLUSION
Petition to Approve Compromise of
Pending Action on Behalf of Minor Emma Lynn Espindola filed by Petitioner Ana Erika
Espindola is GRANTED. The Court orders the net balance be deposited in a single-premium deferred
annuity as outlined in Attachment 18b(3).
Petitioner is ordered to give notice
of this ruling.
Petitioner is ordered to file the proof of service of this
ruling with the Court within five days.
The parties are directed to the header of this
tentative ruling for further instructions.
