Ruling on Defendant Super Center Concept’s Unopposed Motion to Deem Requests for Admission Admitted

            Having reviewed Defendant Super Center Concept’s unopposed Motion to Deem Requests for Admission Admitted, the Court rules as follows.

            On October 14, 2022, Defendant Super Center Concept served Requests for Admission, Set No. One, on Plaintiff D’Twone Vercher.

Responses were due November 13, 2023. D’Twone Vercher has failed to provide timely responses.  Defendant Super Center Concept now moves the Court to deem the requests for admission admitted. 

            The Court grants the motion pursuant to Code of Civ. Proc. § 2033.280 and deems the requests to be admitted.

 

Defendant Super Center Concept requests monetary sanctions totaling $1,320.00.

            The Court awards sanctions pursuant to Code of Civ. Proc. § 2023.030 (a) and Code of Civ. Proc. § 2033.280 (c) in the amount of $690.00, calculated as follows:

Defendant requests $1,320.00 in sanctions based on 6 hours of attorney’s work, at a rate of $210.00 per hour, and 1 $60.00 filling fee. Attorney’s work consists of 3 hours of drafting, 2 hours replying to any opposition and 1 hour attending the hearing. The motion is unopposed. The Court awards sanctions totaling $690.00, based on 3 hours of attorney’s work and 1 filling fee.

The sanctions total $690.00 and are payable by D’Twone Vercher and his counsel by March 31, 2023.
