Ruling on Plaintiff William Zimmer’s Unopposed Motion to Deem Requests for Admission Admitted

            Having reviewed Plaintiff William Zimmer’s unopposed Motion to Deem Requests for Admission Admitted, the Court rules as follows.

            On April 22, 2022, Plaintiff William Zimmer served Requests for Admission, Set No. One, on Defendant Benny Gonzales, Jr.

Responses were due May 27, 2022.  Defendant Benny Gonzales, Jr. has failed to provide timely responses.  Plaintiff William Zimmer now moves the Court to deem the requests for admission admitted. 

            The Court grants the motion pursuant to Code of Civ. Proc. § 2033.280 and deems the requests to be admitted.

Plaintiff William Zimmer requests monetary sanctions totaling $1,724.65.

            The Court awards sanctions pursuant to Code of Civ. Proc. § 2023.030 (a) and Code of Civ. Proc. § 2033.280 (c) in the amount of $ 584.65, calculated as follows:

Plaintiff requests sanctions totaling $1,724.65, based on 4.1 hours of attorney’s work, at a rate of $400.00 per hour, one $61.65 filling fee and $23.00 video appearance charge. The Court awards sanctions totaling $584.65, based upon 2 hours of attorney’s work at a reasonable rate of $250.00 per hour, one $61.64 filling fee and $23.00 video appearance charge.

The sanctions total $584.65 and are payable by Defendant Benny Gonzales, Jr. and his counsel by January 7, 2022.
