Ruling on Plaintiff William Zimmer’s Unopposed Motion
to Compel Responses to Form Interrogatories
Having reviewed Plaintiff William Zimmer’s
unopposed Motion to Compel Responses to Form Interrogatories, the Court rules
as follows.
On April 22, 2022, Plaintiff William Zimmer served Form Interrogatories, Set No. One, on
Defendant Benny Gonzales, Jr.
Responses were due May 27, 2022. Defendant Benny Gonzales, Jr. has failed to
provide timely responses. Plaintiff William Zimmer now
moves to compel responses.
The Court grants the motion pursuant to Code of
Civ. Proc. § 2030.290(b) and orders Defendant Benny Gonzales, Jr. to provide verified responses to the
interrogatories compliant with Code of Civ. Proc. §§ 2030.210 (a) and 2030.220 without
objections by January 19, 2023.
Plaintiff
William Zimmer requests monetary sanctions totaling $964.65.
The Court awards sanctions pursuant to Code of Civ. Proc. § 2023.030
(a) and Code of Civ. Proc. § 2030.290 (c) in the amount of $564.56, calculated
as follows:
Plaintiff requests sanctions
totaling $964.65, based upon 2.2 hours of attorney’s work, at a rate of $400.00
per hour, one $61.65 filling fee and one $23.00 video appearance fee. The Court
grants sanctions totaling $564.56, based upon 1 hour of attorney’s work.
The sanctions total $564.56 and
are payable by Defendant Benny Gonzales, Jr. and his counsel by January 19, 2023.
