Petition to Approve Compromise of Pending Action on Behalf of Minor Tabitha Alaria Scott filed by Petitioner Monica Scott

Having considered the petitioning papers, the Court rules as follows. 

BACKGROUND

On April 1, 2022, Plaintiffs Monica Scott (“Monica”) and Tabitha Alaria Scott (“Tabitha”) filed this action against Defendant Team Rooter, Inc. (“Rooter”) and Geovanni Esau Penate (“Penate”) for motor vehicle negligence.

On May 17, 2022, Defendants filed an answer.

On December 23, 2022, Petitioner Monica Scott filed a Petition to Approve Compromise of Pending Action on Behalf of Minor Tabitha Alaria Scott to be heard on February 8, 2023.

PARTY’S REQUESTS

Petitioner Monica Scott asks the Court to approve the compromises of the pending action on behalf of Plaintiff Tabitha Alaria Scott.

DISCUSSION

Petitioner’s application does not contain an attachment with information about the single-premium deferred annuity subject to withdrawal, despite that being the requested means of delivery. The Court denies the petition.

CONCLUSION

Petition to Approve Compromise of Pending Action on Behalf of Minor Tabitha Alaria Scott filed by Petitioner Monica Scott is DENIED.

Petitioner is ordered to give notice of this ruling.

Petitioner is ordered to file the proof of service of this ruling with the Court within five days.
