Holding LP’s Request for Default Judgment
Having considered all documents submitted in support of a default
judgment, the Court rules as follows:
Background
On July 11, 2022,
Plaintiff GVC Holding LP (“Plaintiff”) filed this action against Defendant Ben
Amin Assil, dba Cal Café (“Defendant”) for breach of lease. Plaintiff filed the operative first amended
complaint on May 9, 2023.
On September 29,
2023, the clerk entered default against Defendant. On November 17, 2023,
Plaintiff filed a Request for Court Judgment to be heard on December 19, 2023.
Party’s Request
Plaintiff requests the Court to enter a
default judgment against Defendant Ben Amin Assil, dba Cal Café and award Plaintiff $126,406.89
consisting of $112,135.48 as the demand of the complaint, $10,550.94 in
prejudgment interest, $3,011.35 in attorney’s fees, and $709.12 in costs.
Discussion
Plaintiff
submitted a completed default judgment packet, with all applicable attachments.
The Court finds sufficient evidence to justify the requested award and grants
Plaintiff’s request in full.
Conclusion
The application
for default judgment filed on November 13, 2023, is granted. Judgment of $126,406.89 is entered against Defendant.
Plaintiff is ordered to give notice of
this ruling.
