Plaintiff Hashem 26, LLC’s Request for Default Judgment

          Having considered all documents submitted in support of a default judgment, the Court rules as follows.

 

Background

On November 30, 2022, Plaintiff Hashem 26, LLC (“Plaintiff”) filed this action against Defendants Victor Manuel Olazabal, Joselyn Olazabal, and Chemo’s Upholstery (collectively, “Defendants”) for breach of lease, breach of personal guaranty, unfair business practice pursuant to Business & Professions Code §17200, and retaliation.

On November 14, 2023, the clerk entered default against Defendants. On March 1, 2024, Plaintiff filed a Request for Court Judgment to be heard on April 4, 2024.

 

Party’s Request

Plaintiff requests the Court to enter a default judgment against Defendants Victor Manuel Olazabal, Joselyn Olazabal, and Chemo’s Upholstery and award Plaintiff $102,200.92 consisting of $89,450.00 as the demand of the complaint, $8,945.00 in prejudgment interest, $2,679.00 in attorney’s fees, and $1,126.92 in costs.

 

Discussion

Plaintiff submitted a completed default judgment packet, with all applicable attachments. The Court finds sufficient evidence to justify the requested award and grants Plaintiff’s request in full.

 

Conclusion

The application for default judgment filed on March 1, 2024, is GRANTED. Judgment of $102,200.92 is entered against Defendants Victor Manuel Olazabal, Joselyn Olazabal, and Chemo’s Upholstery.
