Plaintiff Cargo Express Freight Corp.’s Request for Default Judgment

          Having considered all documents submitted in support of a default judgment, the Court rules as follows:

 

Background

On November 28, 2022, Cargo Express Freight Corp. (“Plaintiff”) filed this action against Defendant Next Generation Logistics, Inc. dba ABC Depot Logistics (“Defendant”) for breach of contract, quantum meruit, open book account, account stated, and common counts.

On October 17, 2023, the clerk entered default against Defendant. On January 25, 2024, Plaintiff filed a Request for Court Judgment to be heard on February 26, 2024.

 

Party’s Request

Plaintiff requests the Court to enter a default judgment against Defendant and award Plaintiff $56,986.41 consisting of $47,562.91 as the demand of the complaint, $6,737.95 in prejudgment interest at the annul rate of 10%, $1,816.86 in attorney fees, and $868.69 in costs.

 

Discussion

Plaintiff submitted a completed default judgment packet, with all applicable attachments. The Court finds sufficient evidence to justify the requested award and grants Plaintiff’s request in full.

 

Conclusion

The application for default judgment filed on January 25, 2024, is granted.  Judgment of $56,986.41 is entered against Defendant.

Plaintiff is ordered to give notice of this ruling.
