Plaintiff Xchange Logistics Corporation’s Request for
Default Judgment
Having considered all documents submitted in support of a default
judgment, the Court rules as follows:
Background
On February 9, 2023, Xchange
Logistics Corporation (“Plaintiff”) filed its intial Complaint against
Defendants HK Logistics Corp. and Miguel Angel Roque II. On September 7, 2023, Plaintiff filed the
operative first amended complaint (“FAC”) against Defendants HK Logistics Corp.
and Miguel Angel Roque II for conversion, breach of contract, negligence,
intentional interference with contractual relations, violation of business and
professions code 17200, and common count: money had and received. On April 12, 2024, Plaintiff amended its pleading
to name Defendant HK Trans LLC as Doe 1.
On June 4, 2024, the clerk
entered default against HK Logistics Corp. and Miguel Angel Roque II. On August 21, 2024, the clerk entered default
against HK Trans, LLC. On December 18,
2024, Plaintiff filed a Request for Court Judgment to be heard on January 8,
2025.
Party’s Request
Plaintiff requests the Court to enter a
default judgment against Defendants and award Plaintiff a judgment of $6,500,832.50
consisting of $6,500,000.00 in damages and $832.50 in costs.
Discussion
Plaintiff submitted a
completed default judgment packet, with all applicable attachments. The Court
finds sufficient evidence to justify the requested award and grants Plaintiff Xchange
Logistics Corporation’s request in full.
Conclusion
The application for default
judgment filed on December 18, 2024, is granted. Judgment of $6,500,832.50 is
entered against Defendants HK Logistics Corp., Miguel Angel Roque II, and HK
Trans, LLC.
Plaintiff is ordered to give notice of
this ruling.
