Plaintiff Jonathan Neil
& Associates, Inc.’s Request for Default Judgment
Having considered all documents submitted in support of a default
judgment, the Court rules as follows:
Background
On June 20, 2023, Jonathan
Neil & Associates, Inc. (“Plaintiff”) filed this action against Defendants Machine
Dynamics, Inc., and Eric Rawa (collectively, “Defendants”) for eight causes of
action: (1) open book account, (2) account stated, (3) money had and received,
(4) breach of promissory note, (5) breach of guaranty, (6) breach of security
agreement, (7) claim and delivery, and (8) conversion.
On September 11, 2023,
the clerk entered default against Defendants. On January 2, 2024, Plaintiff
filed a Request for Court Judgment to be heard on January 11, 2024.
Party’s Request
Plaintiff requests the Court to enter a
default judgment against Defendants and award Plaintiff $82,169.13,
consisting of $73,024.52 as the demand of the complaint, $6,222.09 in
prejudgment interest, $572.02 in costs, and $2,350.50 in attorneys’ fees.
Discussion
Plaintiff submitted a
completed default judgment packet, with all applicable attachments. The Court
finds sufficient evidence to justify the requested award and grants Plaintiff’s
request in full.
Conclusion
The application for
default judgment filed on January 2, 2024, is granted. Judgment of $82,169.13 is entered against Defendants.
Plaintiff is ordered to give notice of this
ruling.
