The Court notes that Plaintiff has obtained a Default against Defendant.  The Court therefore discharges the Order to Show Cause regarding same set for hearing on April 10, 2024. 

The Court further notes that Plaintiff has submitted a partial request for entry of default judgment.  The Court denies Plaintiff’s default judgment packet. 

The Court sets a hearing on an order to show cause why the complaint should not be dismissed and/or Plaintiff’s counsel sanctioned $250 for failing to enter default judgment (California Rule of Court, rule 3.110(h)) on May 14, 2024, at 8:30 AM in Department 71 at Stanley Mosk Courthouse for the following reasons:

1.     No Proposed Judgment Form (JUD-100).

 

2.     No Request for Court Judgment on the mandatory Judicial Council form CIV-100.

 

3.     No declaration of Plaintiff or declarant with percipient knowledge competent to testify and authenticate the evidence to support the damages claimed.  No declaration submitted and signed under penalty of perjury.  (C.C.P. §2015.5.)
