            Note that once the Court has issued a tentative, the Court has the inherent authority not to allow the withdrawal of a motion and to adopt the tentative ruling as the order of the court.

The Court considers:

1)    The Crème Shop Inc.’s motion to compel Non-party Toji Co. to comply with a deposition subpoena for the production of business records. 

2)    Plaintiff The Crème Shop Inc.’s motion to compel Non-party Somi Sunday LLC to comply with a deposition subpoena for the production of business records.

3)    Plaintiff The Crème Shop Inc.’s motion to compel Non-party LPF Corp. to comply with a deposition subpoena for the production of business records.

4)    Plaintiff The Crème Shop Inc.’s motion to compel Non-party Pureunbi Corp. to comply with a deposition subpoena for the production of business records.

5)    Plaintiff The Crème Shop Inc.’s motion to compel the production of Paul Kim’s employment records.

6)    Plaintiff The Crème Shop Inc.’s motion to compel the production of Sunna Kim’s employment records.

The Court questions whether each of the third-parties against whom relief is sought was personally served with the motion to compel it to produce documents (California Rule of Court, rule 3.1346), or whether counsel for each third-party waives such service.
