Plaintiff Circa 1200, LLC’s Request for Default Judgment

 

          Having considered all documents submitted in support of a default judgment, the Court rules as follows:

 

Background

On December 14, 2023, Plaintiff Circa 1200, LLC (“Plaintiff”) filed its operative Complaint for breach of contract and common counts against Defendant James Nicholas (“Defendant”).

On January 7, 2025, the clerk entered default against Defendant. On March 20, 2025, Plaintiff filed a Request for Court Judgment to be heard on April 21, 2025.

 

Party’s Request

Plaintiff requests the Court to enter a default judgment against Defendant and award Plaintiff a judgment of $110,217.95 consisting of $91,306.91 in damages, $17,711.04 in prejudgment interest at the annual rate of 10%, $83.24 in attorneys’ fees, and $1,116.76 in costs.

 

Discussion

Plaintiff submitted a completed default judgment packet, with all applicable attachments. The Court finds sufficient evidence to justify the requested award and grants Plaintiff’s request in full.

 

Conclusion

The application for default judgment filed on March 20, 2025, is granted.  Judgment of $110,217.95 is entered against Defendant James Nicholas.

Plaintiff is ordered to give notice of this ruling.
