Plaintiff Wells Fargo Bank, National Association’s
Request for Default Judgment
Having considered all documents submitted in support of a default
judgment, the Court rules as follows:
Background
On April 23, 2023,
Wells Fargo Bank, National Association (“Plaintiff”) filed its Complaint
against Defendants Crown Royalties LLC. and Jonathan J. Margullis aka Jonathan
Joseph Margullis aka Jonathan Marguies (collectively, “Defendants”) for breach
of ontract, account stated, money lent, and breach of guaranty.
On June 5, 2024,
the clerk entered default against Defendants.
On June 14, 2024, Plaintiff filed a Request for Court Judgment to be
heard on August 9, 2024.
Party’s Request
Plaintiff requests the Court to enter a
default judgment against Defendants and award Plaintiff $102,871.14 consisting
of $99,361.63 as the demand of the Complaint, $2,877.21 in attorneys’ fees, and
$632.30 in costs.
Discussion
Plaintiff submitted
a completed default judgment packet, with all applicable attachments. The Court
finds sufficient evidence to justify the requested award and grants Plaintiff Wells
Fargo Bank, National Association’s request in full.
Conclusion
The application
for default judgment filed on June 14, 2024, is granted. Judgment of $102,871.14 is entered against Defendants Crown Royalties LLC. and Jonathan J.
Margullis aka Jonathan Joseph Margullis, aka Jonathan Marguies.
Plaintiff is ordered to give notice of
this ruling.
