Plaintiff Wells Fargo Bank, National
Association’s Request for Default Judgment
Having considered all documents submitted in support of a default
judgment, the Court rules as follows:
Background
On October 8, 2024, Wells
Fargo Bank, National Association (“Plaintiff”) filed its operative Complaint
against Defendant Ara B Akaragian, an individual, aka Ara Berdj Akaragian, aka
Ara Akakagian, aka Ara B Akarajian (“Defendant”) for a single cause of action
for breach of guaranty.
On November 19, 2024, the
clerk entered default against Defendant. Plaintiff filed a Request for Court
Judgment to be heard on February 10, 2025.
Party’s Request
Plaintiff requests the Court to enter a
default judgment against Defendant and award Plaintiff a judgment of $93,927.82
consisting of $90,663.70 in damages; $560.85 in costs; and $2,703.27 in
attorneys’ fees.
Discussion
Plaintiff submitted a
completed default judgment packet, with all applicable attachments. The Court
finds sufficient evidence to justify the requested award and grants Plaintiff Wells
Fargo Bank, National Association’s request in full.
Conclusion
The application for default
judgment filed on December 10, 2024, is granted. Judgment of $93,927.82 is
entered against Defendant Ara B Akaragian, an individual, aka Ara Berdj
Akaragian, aka Ara Akakagian, aka Ara B Akarajian.
Plaintiff is ordered to give notice of
this ruling.
