Request for Default Judgment
Having considered all documents submitted in support of a default
judgment, the Court rules as follows:
Background
On October 23, 2024, Plaintiff
Pomona 196 LLC (“Plaintiff”) filed its operative Complaint for breach of contract-
secured promissory note, breach of contract- loan agreement, breach of
contract- security agreement, breach of the implied warranty of good faith and
fair dealing, unjust enrichment, and declaratory relief against Defendant OGC
Systems, Inc. dba New Generation and/or Green Monkey (“Defendant”).
On December 26, 2024, the
clerk entered default against Defendant. On May 23, 2025, Plaintiff filed
Request for Court Judgment to be heard on June 4, 2025.
Party’s Request
Plaintiff requests the Court to enter a
default judgment against Defendant and award Plaintiff a judgment of $444,215.08
consisting of $333,410.50 in damages; $60,985.00 in prejudgment interest at a
rate of 15%, in compliance with Corp. Code §25118; $903.58 in costs; and $48, 916.00
in attorneys’ fees.
Discussion
Plaintiff submitted a
completed default judgment packet, with all applicable attachments. The Court
finds sufficient evidence to justify the requested award and grants Plaintiff’s
request in full.
Conclusion
The application for default
judgment filed on May 23, 2025, is granted.
Judgment of $444,215.08
is entered
against Defendant OGC Systems, Inc. dba New Generation and/or Green Monkey.
Plaintiff is ordered to give notice of
this ruling.
