     [TENTATIVE] order RE:

defendants david martinez’s and carlos martinez’s demurrers to third amended complaint

 

 

BACKGROUND

            On January 26, 2021, Plaintiff Cloud Mountain, Inc. filed this action against Defendants David Martinez, Carlos Martinez, and Cojecto. The operative Third Amended Complaint was filed on March 7, 2022. On March 8, 2022, Defendants David and Carlos Martinez each filed demurrers against the fourth and fifth causes of action for intentional and negligent misrepresentation.         

            However, the case was automatically stayed due to a bankruptcy filing by Plaintiff. On September 12, 2022, Plaintiff filed a status report indicating that the bankruptcy proceeding is still pending.

CONCLUSION

            The matter is taken off calendar due to the pending stay.
