BACKGROUND

            On March 10, 2022, Plaintiffs Clare Sassoon and Thomas Kielty initiated this tenant action against Defendants. The operative First Amended Complaint alleges (1) breach of contract, (2) breach of the covenant of good faith and fair dealing, (3) tenant harassment, (4) interference with contract, and (5) declaratory relief.

            Defendants had been sued for tenant harassment and other wrongful acts previously, which resulted in a settlement agreement. The agreement provided, in pertinent part, that Judge Carl West or the successor in Department 311 shall have jurisdiction over any new claims involving similar issues. This action arises from Defendants’ alleged continued harassment of Plaintiff tenants in violation of the agreement. Plaintiffs presently move to transfer the case to Department 14 at the Spring Street Courthouse because Judge Freeman is the successor to Judge West.

DISCUSSION

            This Court does not have authority to transfer the case to another department. Plaintiffs should make their request to Department 1 or the court where they seek to have the case transferred, Department 14.

CONCLUSION

            Plaintiffs’ motion to transfer is DENIED.
