BACKGROUND
On October 1, 2024, Plaintiffs Juan
Ceja and Janay Ceja filed this negligence action against Defendants Wadco
Industries, Inc., a Delaware corporation; Wadco Industries, Inc., a California
corporation; Western Metal Service, Inc., a California corporation; Wadco
Industries, an unknown entity; Western Metal Service, Inc., an unknown entity;
and Rafael Martinez, an individual. The action stems from an auto accident
which occurred in Fontana, California.
On March 6, 2025, Defendants filed
the instant motion to change venue to San Bernardino County.
DISCUSSION
The proof of service on the motion
indicates mail service to the address 9454 Wilshire Blvd., Ste. 601, Beverly
Hills, CA 90211. However, the correct zip code for Plaintiff’s counsel’s
address is 90212. Plaintiff has not filed an opposition, indicating that
his counsel did not receive the motion due to the incorrect address. Therefore,
the motion is denied for lack of proper service.
CONCLUSION
Defendants’
motion to change venue to San Bernardino County is DENIED.
