The Motion to Bifurcate Trial on the Issues of Liability and Damages filed by Defendant Linda Jo Warren Dzima is DENIED without prejudice.
This court’s standard practice is to rule on a motion to bifurcate just before trial as an exercise of discretion when the court and the parties are most familiar with all the issues and the posture of the case at the time of trial (e.g., the availability of witnesses, etc.). (See CCP § 598). The court sees no reason to deviate from that practice here. Thus, while the court recognizes that there may be cause to bifurcate in this case, the court will deny the motion at this time without prejudice to a renewed motion just before trial.
