Plaintiff Stephen C. Socik Trust’s (“Plaintiff”) Motion for Leave to File a Second Amended Complaint (“SAC”) is DENIED.
This is the second time this motion has been filed by Plaintiff. The previous time the court denied the motion as Plaintiff failed to abide by three requirements of CA ST CIVIL RULES Rule 3.1324. (ROA #122.). These requirements were specified in the court’s ruling. The court denied the motion without prejudice to a future request that complied with the rules.
In this motion, Plaintiff has once again failed to abide by the requirements of CA ST CIVIL RULES Rule 3.1324. Plaintiff has again failed (1) to file a complete copy (or any copy) of the proposed amended complaint, (2) to specify the effect of the amendment and why, if the facts were known at the time the original complaint was filed, the allegations were not included therein or at an earlier time, and (3) to identified by page, paragraph, and line number the items being deleted and added between the FAC and SAC. (See CA ST CIVIL RULES Rule 3.1324(a), (b)). Thus, the motion is denied.
Plaintiff is ordered to give notice of this ruling.
