Defendant Mark Ike’s (“Moving Party”) Motion to Dismiss Plaintiff VAOC Newport Plaza, LP’s Complaint against Moving Party is DENIED.

 

Moving Party failed to file a proof of service of the motion. (CRC 3.1300(c).) There is no opposition filed. Thus, the Court lacks any indication of service of the moving papers on Plaintiff. In addition, the motion fails to cite any authority by which the Court may grant this motion to dismiss. Moving Party cites two cases to support his argument that the contract at issue is unenforceable, but he fails to provide a legal basis authorizing the Court to dismiss the action. Thus, it is unclear on what ground Moving Party seeks relief. (See Needelman v. DeWolf Realty Co., Inc. (2015) 239 Cal.App.4th 750, 762—Issues not supported by argument or citation to authority are forfeited.)

 

Accordingly, the motion is denied.
