Judge: David A. Hoffer, Case: 30-2021-1196798, Date: 2022-08-15 Tentative Ruling

The unopposed motion by plaintiff Joe Specht (“plaintiff”) to compel further responses from defendant Advanced Industrial Solutions, Inc. (“AIS”) to Request for Production of Documents (“RFPS”), Set one is GRANTED.

AIS waived all objections to plaintiff’s first set of RFPS when it failed to serve a timely response to the demand. (CCP §2031.300(a)) AIS is therefore ordered to serve further verified responses to plaintiff’s first set of RFPS, without any objections, within 10 days from the date of the hearing. 

AIS is further ordered to pay $810 in monetary sanctions to plaintiff within 60 days for the reasonable expenses and attorney’s fees incurred by plaintiff in connection with this motion. The court finds no substantial justification or other circumstances making the imposition of the sanction unjust. However, AIS alone shall pay the sanctions because the Notice of Motion does not request sanctions against AIS’s counsel (even though sanctions are requested against defense counsel in the body of the motion). (See CCP §2023.040)

Plaintiff is ordered to give notice of this ruling.
