The Motion to be Relieved as Counsel of Record, filed by Jonathon D. Sayre of Manning & Kass, Ellrod, Ramirez, Trester LLP, as to the representation of Defendant Avex Builders, Inc. is DENIED, without prejudice.

The Motion does not include the proposed order (on Form MC-053), as required under CRC 3.1362(e).  It also fails to adequately show that service on the client was proper.  (See ROA 101 at ¶3(b), (c).)  The Motion is therefore DENIED, without prejudice to a renewed motion which complies with all of the requirements stated in C.R.C. 3.1362.

Moving counsel is ordered to give notice of this ruling.
