Judge: David A. Hoffer, Case: 30-2022-1259823, Date: 2022-11-07 Tentative Ruling

Plaintiff BMW Bank of North America’s unopposed Application for Writ of Possession against Defendant Robert Fichidzhyan for the 2022 BMW 740i sedan motor vehicle, Serial No. WBA7T2C02NCH08074 (the “Vehicle”) is GRANTED.  Plaintiff has met all of the conditions of Code Civ. Proc. §§ 512.060(a)(1), 511.090 and no opposition has been filed.

The Court orders Defendant Fichidzhyan to turn over to Plaintiff the Vehicle which is believed to be located at 15957 Liggett St., North Hills, CA 91343. The failure to turn over the Vehicle to Plaintiff may subject Defendant to being held in contempt of court. The Court waives the requirement for Plaintiff to post an undertaking since the amount owed is higher than the estimated value of the Vehicle. 

Defendant’s re-delivery bond shall be $94,000.

Moving Party is ordered to give notice of this ruling.
