The motion by plaintiffs Carey Baca and Mathew Baca to consolidate Orange County Superior Court Case No. 2022-01272726 (Baca Action) and Orange County Superior Court Case No. 2022-01267571 (UD Action) is DENIED.

 

For a Motion to Consolidate, California Rule of Court 3.350 provides in part as follows:

(a) Requirements of motion.  (1) A notice of motion to consolidate must: …(C) Be filed in each case sought to be consolidated.  The motion does not comply with Rule 3.350(a)(1)(C) in that it was not filed in the UD case.  Furthermore, even if the motion did comply with the rules, the court would nevertheless deny it as it would have the effect of unnecessarily delaying and complicating the UD action (intended to be a summary action for possession of premises) with written discovery, pleadings, depositions, witnesses, etc. 

 

The defendants in the Baca Action are ordered to give notice of this ruling.
