20GDCV00906 Grigorian, et al. v. Uhm, et al.-Supplemental tentative
ruling on Motion to quash service of summons and to set aside default.
The two defendants named in this case each filed motions to
quash service of summons and to set aside the default that had been entered
against them. The defendants were served by substituted service on May 26,
2021. Their defaults were entered on 12/1/2021,
these motions were filed on 1/24/2023, and were originally heard on 4/14/2023. The Court provided a tentative ruling. At the hearing, the Court exercised its
discretion to continue the hearing to this date and allowed the parties to file
supplemental briefs and declarations. Both plaintiffs and both defendants
timely did so.
Having now considered the supplemental filings of all
parties, the Court denies the motions to quash service of summons and to set
aside default in this matter. While defendants Jay Uhm and Diane Uhm did
provide further declarations in an attempt to make clearer their residency and
their connection, or lack thereof to Tanhay, Inc., these supplemental
declarations were direct and rather bare assertions. The supplemental declarations
of the two defendants have been impeached by the supplemental declaration of Armando
Limon on behalf of Plaintiffs.
Defendants late submitted additional Declarations and documentation on
April 26, 2023.
The Court continues the hearing on the Order to show cause
re: Default Judgement to June 29, 2023, @9:00 a.m. in Glendale Dept. E. If Default Judgments have been entered
against both defendants by then, no appearance is necessary.
