TENTATIVE RULING

In reviewing your motion for final approval of class action settlement, the Court orders further briefing and/or supplemental filings as to the items discussed below:

1.     The Settlement Administrator (Simpluris) must provide a declaration evidencing that it issued notice to the class pursuant to the procedure previously described to the Court at preliminary approval.  The administrator must confirm the class size, the deadline established for class members to respond, and the number of exclusions and/or objections received (if any) as of the response deadline.  The administrator should also confirm its total costs requested for this action.  Attached to the declaration should be a copy of the Notice form that the administrator issued to the class.  The Court will not issue final approval of the settlement without the administrator’s declaration.

All filings in response to this ruling must be submitted 16 court days before the next final approval hearing date.
