NO TENTATIVE RULING

On September 7, 2022, Plaintiff Sarah R. Chiusano filed a notice of settlement of entire case, indicating that a request for dismissal will be filed by October 30, 2022.  Defendant Uber Technologies (“Uber”) should be prepared to address whether it is still proceeding with its motion to enforce settlement under Code of Civil Procedure section 664.6.

In addition, Uber filed a motion to seal, set to be heard on October 7, 2022.  The motion to seal relates to documents submitted in support of this motion to enforce settlement.  Uber represented in its notice of lodging that it lodged unredacted copies of the instant motion to enforce settlement and Exhibit A to Jeffrey Liu’s declaration in support of the instant motion.  (See Not. of Lodging, at p. 2 [ROA 155].)  As of September 8, 2022, the unredacted documents were not lodged.  Uber should be prepared to address whether it will be withdrawing its motion to seal, since there are no unredacted documents to seal.
