NO TENTATIVE RULING
Plaintiffs Melissa Carandang, Matthew Graves, Virginia Carandang, and Orlando Carandang seek a preliminary injunction preventing Defendant Samaneh Pourjalali or any new tenants from inhabiting her unit until the property complies with the Conditions, Covenants, and Restrictions.
The parties should be prepared to discuss whether the scope of the preliminary injunction sought is narrowly tailored to prevent the alleged harm at issue. (Thompson v. 10,000 RV Sales, Inc. (2005) 130 Cal.App.4th 950, 979-980.)
In addition, the parties should be prepared to address the appropriate amount of an undertaking, which is required upon granting a preliminary injunction. (Code Civ. Proc., § 529; Stevenson v. City of Sacramento (2020) 55 Cal.App.5th 545, 548, 551.) For instance, should the undertaking be based upon six months of rent for Pourjalali’s unit?
