Plaintiff Yelena Ilnitskaya motion to enforcing settlement agreement is denied.

Plaintiff did not show the moving papers or reply were properly served on Defendants Assent Mortgage, LLC, Nepka, Inc., and Mahyar Kazemi, who have appeared in this matter.  After a defendant appears, that “defendant or the defendant’s attorney is entitled to notice of all subsequent proceedings of which notice is required to be given.”  (Code Civ. Proc., § 1014.)  “Proof of service of the moving papers must be filed no later than five court days before the time appointed for the hearing.”  (Cal. Rules of Court, rule 3.1300(c).)  Accordingly, the unopposed motion is denied.

Plaintiff shall give notice of the ruling.
