Judge: Deborah C. Servino, Case: 30-2020-01220283, Date: 2022-09-09 Tentative Ruling

Defendant Karen Guiney’s (“Defendant”) motion to compel Plaintiff Joe Gorrie to respond to form interrogatories, set one, is moot except for the issue of sanctions.  Prior to the hearing, responses were served.  (Gerber Decl., at ¶ 4, Exh. C.)  Within 30 days of the notice of ruling, Plaintiff and his counsel, Sehgal Law, PC and Miller Gerber LLP, jointly and severally shall pay sanctions in the amount of $660 to Douglas D. Alani. (Code Civ. Proc., § 2030.290, subd. (c); Cal. Rules of Court, rule 3.1348(a).)  

 

Plaintiff is represented by two law firms.  He contends Defendant must serve both firms, but offers no legal authority to support such a demand.  When a party is represented by several separate attorneys or law firms of record, notice served on one of them is sufficient and proper.  (Adaimy v. Ruhl (2008) 160 Cal.App.4th 583, 587-588.) 

 

Defendant shall give notice of the ruling and of the continued case management conference.

The case management conference is continued to November 4, 2022 at 10 am to be heard concurrently with the motion to quash service of summons.
