Judge: Deborah C. Servino, Case: 30-2021-01214289, Date: 2022-09-16 Tentative Ruling

The motion of Borton Petrini, LLP, through Mark Shrem, counsel of record for Defendants American General Construction, Inc. and Jonathan Michael Coit, for an order relieving as counsel for Defendant American General Construction, Inc., is granted.

Upon the signing of the proposed order, counsel shall serve the signed order on Defendant American General Construction and all parties.  Counsel will be relieved as counsel of record for Defendant American General Construction, effective upon the filing of the proof of service of the signed order upon Defendant American General Construction and all parties.

The proposed order indicates that a jury trial is scheduled for January 23, 2023.  However, at the January 14, 2022 case management conference, a court trial was scheduled for January 23, 2023. 

When defense counsel filed its motions to be relieved as counsel for Defendant, Plaintiff United Rentals (North America), Inc. had not yet filed its motion for summary judgment or for summary adjudication.  The proposed order that was electronically received by the Court and served on Defendant American General Construction, does not include the upcoming October 21, 2022 hearing on the motion.  The Court will modify the order to include the October 21, 2022 hearing date and to indicate that a court trial has been scheduled.   

The motion was only as to Defendant American General Construction, Inc.  At this time, Borton Petrini, LLP is still counsel of record for Jonathan Michael Coit. 

Counsel shall give notice of the ruling.
