NO TENTATIVE RULING

Due to a calendaring error, Plaintiff filed an untimely opposition to the motion to compel arbitration.  (Amarkarian Decl., at ¶ 8.)  Plaintiff requested that the court consider the opposition and continue the hearing of the motion to allow Defendant time to file a reply.  After the motion to compel arbitration was filed, the opinion in Ochoa v. Ford Motor Company (2023) 89 Cal.App.5th 1324 was filed on April 4, 2023.  There is now a split in authorities.  (Id. at pp. 619-620.)  It would assist the court for Defendant to file a reply brief that specifically addresses which line of authorities should be followed. 

The hearing on the motion to compel arbitration is continued to June 23, 2023 at 10 am in Dept. C21.  Defendant may file a reply and supporting papers based upon that continued hearing date.

Plaintiff shall give notice of the continued hearing date and of this Order.
