Plaintiff Shoura Khatibloo, MBA, MA, LMFT, PhD's motion to compel Defendant Maria Delvarani's deposition and production of documents, is denied.  Plaintiff's motion to compel Defendant to respond to: (1) form interrogatories (set one); (2) special interrogatories (set one); and (3) request for production of documents (set one), is also denied.

Here, default was entered as requested against Defendant on November 21, 2022.  As a result of the default entered in this action against Defendant, the court no longer has jurisdiction to grant Plaintiff’s motions to compel.  (Todd v. Everett (1966) 247 Cal.App.2d 209, 211-212; W. A. Rose Co. v. Municipal Court for Oakland-Piedmont Judicial Dist., Alameda County (1959) 176 Cal.App.2d 67, 72-73.)

The case management conference is continued to July 7, 2023 at 10 am in Department C21, to be heard concurrently with the scheduled motion to set aside/vacate default.

Plaintiff shall give notice of the ruling and of the July 7, 2023 continued case management conference.
