Petitioner Chong Yun’s motion to for an order to set aside Respondent Director of the Department of Motor Vehicle’s order suspending or revoking Petitioner’s license is denied.

at the time Petitioner filed the motion, it does not appear that he had properly served Respondent with the Petition for Alternative Writ of Mandate to confer jurisdiction over Respondent.  (See Code Civ. Proc., §§ 410.50, 417.10-417.40.)  Accordingly, the motion was not properly served.  Furthermore, the motion is not supported by any admissible evidence and is not accompanied by any memorandum of points and authorities.  (See Cal. Rules of Court, rule 3.1110, et seq.)  Accordingly, the motion is denied.

Petitioner shall give notice of the ruling.
