The motion of attorney Simon Esfandi from Compass Law Group, LLP to be relieved as counsel of record for plaintiff Richard Jones is CONTINUED to _____.

 

California Rules of Court, Rule 3.1362, subdivision (d) states in pertinent part: “The notice of motion and motion, the declaration, and the proposed order must be served on the client and on all other parties who have appeared in the case.”

 

The Proof of Service filed by moving counsel shows that only the “Notice of Motion and Motion to Be Relieved as Counsel – Civil” was served on Plaintiff and defendant Starbucks Corporation. (ROA No. 74.) Moving counsel has not shown that the declaration and the proposed order were served as required by Rule 3.1362, subdivision (d).

 

Based on the foregoing, the hearing on the Motion is CONTINUED to ________. Moving counsel is to give notice and to serve the notice of motion, declaration and proposed order with the new hearing date on the client and all other parties who have appeared in the case.
