TENTATIVE RULING:
Plaintiffs in pro per Jon B. Hultman and Natsuko Hultman move to compel further responses from Defendants Peter Huei Hsiang Wang and Esther Tsan Ya Wang to Form Interrogatories (Set One) and RFAs (Set One). For the following reasons, the motions are DENIED as moot.
Plaintiffs move for further responses to Form Interrogatory No. 15.1 and RFA Nos. 1-2. On 10/24/2022, Defendants served further responses to those discovery requests. (Chow Decls. ¶¶ 11, 13.)
Plaintiffs’ request for monetary, issues, and/or terminating sanctions is DENIED.
Self-represented litigants cannot recover attorney’s fees as a discovery sanction. (Argaman v. Ratan (1999) 73 Cal.4th 1173, 1179.) In addition, Plaintiffs fail to justify the imposition of issues or terminating sanctions, as those sanctions may be awarded only if a party fails to obey a court order compelling answers. (See Code Civ. Proc., § 2030.290(c).)
